For almost thirty years, the murder of Tupac Shakur belonged to everyone except a courtroom. It lived in documentaries and podcast episodes, in barbershop theories and message-board deep dives, in the mouths of men who claimed to know and the silence of men who actually did. It was the most discussed unsolved case in hip-hop history, and for three decades the discussion was all anyone got.

On Monday, August 31, that changed. A jury in Clark County, Nevada found Duane “Keffe D” Davis, 63, guilty of first-degree murder with the use of a deadly weapon for orchestrating the September 1996 drive-by that killed Shakur near the Las Vegas Strip. It is the first and only conviction ever secured in the case. The panel of ten women and six men deliberated for less than three hours. After thirty years of noise, the answer took an afternoon.

The night, and the silence that followed

The facts of September 7, 1996 were never the mystery. Shakur was riding in a BMW driven by Death Row co-founder Marion “Suge” Knight when a white Cadillac pulled up at a red light and opened fire. Shakur was hit multiple times and died six days later at 25. Knight survived. Hours earlier, Shakur and his entourage had beaten a man named Orlando Anderson in the lobby of the MGM Grand after the Mike Tyson fight. Anderson was Keffe D’s nephew.

Everyone in that world knew the shape of what happened. What they didn’t have was anyone willing to say it under oath. The case went cold not because it was unknowable but because it lived inside a culture with its own rules about talking to police, a silence the streets enforce more reliably than any alibi. For thirty years that silence held.

The man who couldn’t stay quiet

What finally broke the case was not new forensics or a cooperating witness. It was Keffe D himself. Over the years, Davis did the one thing the code forbids: he told the story, again and again, and got paid to do it. He described his role to federal agents in a 2008 proffer session. He said it on camera in a BET documentary. And in 2019 he laid it out in a memoir, Compton Street Legend, complete with a scene of the hunt for Shakur that night.

That was the material that put him in a courtroom. When Las Vegas police arrested him in 2023, he reportedly described his own case as the biggest in the city’s history. He was right about the scale, and wrong about who it would sink. The story he had monetized for years became the evidence against him.

The state’s case was, in the end, an argument that Keffe D had been telling the truth about himself the whole time.

A trial built on his own voice

The prosecution’s strategy was unusual and, it turned out, devastating. Prosecutors Marc DiGiacomo and Binu Palal barely needed to make an argument in their own words. Across two weeks they played roughly eight hours of Davis’s recorded statements, from the 2008 proffer to the documentary to jail calls recorded after his arrest, each version placing him in the Cadillac beside Shakur. Their theory never required him to have pulled the trigger. Under Nevada law, a person who orchestrates a killing is guilty of it, and the state cast Davis as a South Side Compton Crips shot caller who got the gun and gave the order in revenge for his nephew.

The witnesses filled in the frame. An Outlawz member who was there, E.D.I. Mean, described the white Cadillac and the gunfire from the back seat, though he could not name a soul inside it. A retired Compton gang detective testified that a younger member could not have fired with Davis present unless Davis allowed it. Jurors heard Davis, in his own recordings, place the gun in his nephew’s hand and speak of expecting a payoff. They even watched him promote the book, telling viewers they could get the real truth for twenty dollars.

The defense, led by Michael Sanft, had one move and made it repeatedly: none of it was true. Davis’s confessions, Sanft argued, were tall tales manufactured for money and notoriety, and the reason Davis was never charged for decades was that investigators themselves knew he was, in his words, “full of crap.” It was a genuinely strange position, a lawyer asking a jury to believe his client is a liar, and it carried a built-in trap. Sanft called just three witnesses, all former officers, and rested in under two hours. Davis did not testify. After telling jurors not to trust a word the man said, putting him on the stand was never really an option.

The verdict

It did not take long. On an open charge that let them choose second-degree, jurors chose first. Prosecutors dismissed the gang enhancement, so the conviction stands on first-degree murder with a deadly weapon. In his rebuttal, DiGiacomo had held up a scrapbook of Tupac clippings found in Davis’s home and told the jury, “This guy’s scrapbooking his murder, for God’s sake.” The line landed.

The room split the way the case always had. Tupac’s sister, Sekyiwa “Set” Shakur, wept and embraced the prosecutors. Davis’s son covered his face. Davis stood silent as the verdict was read, then raised a fist toward the gallery as he was led out, and told the judge he intends to appeal. He remains jailed ahead of sentencing on October 13, where he faces a maximum of life in prison.

What it actually means

Strip away the history and this is a case about narrative, which is fitting, because so is hip-hop. Keffe D spent years turning his proximity to a legend’s death into currency, understanding better than anyone that in this culture the story is the asset. The tragedy of his conviction is that he was right. The story was worth something. It was worth his freedom.

It is worth being honest about what the verdict does and doesn’t settle. There was no DNA, no murder weapon, no fingerprint placing Davis at the scene; the physical trail went cold decades ago, and the case rested heavily on his own uncorroborated words. An appeal is coming, and the questions that always hovered around this story, including the claims about a payoff and the names Davis floated over the years, were never fully resolved in court. Sean Combs, whose name surfaced in Davis’s own statements, has consistently denied any involvement and was never charged.

But something real happened on Monday that had never happened before. For thirty years the culture told this story to itself, and the telling was all there was. Now twelve strangers have done what no documentary or podcast could. They returned a finding of fact. One of hip-hop’s oldest open wounds finally has a verdict attached to it, and whatever the appeals bring, the record is no longer empty.

What makes the case worth watching is not the celebrity of the defendant. It is the structure of the government’s argument. Prosecutors are asking a jury to accept that a documented, public, extensively recorded period of grief was in fact the opening move of a criminal conspiracy. The defense is asking the same jury to accept that the man who actually built the plot has already confessed to it, and is now on the government’s side of the table.

A note on standards: Durk Banks has pleaded not guilty and is presumed innocent. Everything below that is drawn from indictments, opening statements, or witness testimony is an allegation or an untested claim, and is labeled as such. Nothing here should be read as a finding of fact.

What the Government Says Happened

The federal theory begins on November 6, 2020, when Dayvon Bennett, the rapper King Von, was shot and killed outside an Atlanta hookah lounge. Von was the most prominent artist on Banks’ Only The Family label and, by every public account before and since, one of the closest people in his life.

According to the superseding indictment announced by the U.S. Attorney’s Office for the Central District of California in November 2024, that killing set a retaliation plan in motion. Prosecutors allege that on August 19, 2022, multiple OTF associates used two vehicles to track a rival Atlanta rapper for hours, and that at a gas station near the Beverly Center they fired at least eighteen rounds from multiple weapons, including a machine gun. [U.S. Dept. of Justice] The intended target, identified in coverage as Tyquian Bowman, who records as Quando Rondo, survived. His cousin, Saviay’a Robinson, known as Lul Pab, did not. [AllHipHop]

The government’s indictment names six defendants and alleges that Banks ordered and financed the operation, coordinating flights that carried co-conspirators from Chicago to California. It is the bridge between a man in a studio and a body on a Los Angeles sidewalk, and the government has to build it out of receipts.

The Opening: “Not About Music”

Assistant U.S. Attorney Daniel Weiner opened for the government with a line clearly engineered for the jury pool the court had just spent two days assembling: this case, he said, is not about music, it is about murder. The disclaimer is telling. Prosecutors know exactly how much of this case brushes against expression, and how much a Los Angeles jury in 2026 has been primed to be suspicious of that. Reporting from jury selection captured the problem plainly: one prospective juror said the genre carries negative connotations, and another asked whether lyrics would come with subtitles. Weiner also told jurors that participants faced being pushed out of OTF if they refused to take part, a framing that converts a rap collective into something closer to an employer with disciplinary power. [Los Angeles Magazine] That is not incidental. It is the same theory the government wrote into a fourth superseding indictment three weeks before trial.

The Defense: Point at the Man Who Already Pleaded

Attorney Marissa Goldberg opened for Banks by naming someone else. She told jurors that Kavon Grant, the OTF associate known as Vonnie, was the actual architect of the plot, and that Grant had a motive of his own: he was present when Von was shot and drove him to the hospital. The strategy has an obvious vulnerability and an obvious appeal. Grant has pleaded guilty and agreed to cooperate against Banks. [MyNewsLA] Coverage of the trial’s witness list places him alongside two other OTF-affiliated cooperators, identified as OTF Jam and Flacka, expected to testify for the prosecution. So the defense is not merely denying. It is inviting the jury to run the government’s own math backward: if the man who organized the logistics is now the man buying his freedom with testimony, how much of the story arrived pre-shaped? Goldberg suggested to jurors that Grant redirected blame once he understood what he was facing. [Los Angeles Magazine] Whether that lands depends less on rhetoric than on whether the paper trail needs Grant to explain it.

The Paper Trail Is the Case

Strip away the names and this is a financial and forensic prosecution. In the trial’s first days the government walked jurors through a chain built almost entirely from records: surveillance video of the target being followed, a 911 call from the scene, GPS and speed data pulled from a rented BMW, hotel footage showing vehicles being swapped, rental car paperwork, and flights allegedly purchased on an American Express account tied to Banks. Reporting from the courtroom describes an Encino rental house booked from July 1 to August 18, 2022 for eight occupants and two vehicles, with the paperwork signed by Banks’ manager. [HipHopWired] Prosecutors have also pointed to four black ski masks bought at an REI on August 18 and to flight records placing three men in San Diego the same day. [AllHipHop]

The single most cinematic detail so far belongs to the investigation rather than the crime. AllHipHop, reporting from the courtroom, describes testimony from Detective Warner Carias that the case stalled because the gunmen were masked, and broke open on a pair of black pants with the phrase “Rats to Riches” printed down one leg, caught on video at an In-N-Out roughly 35 minutes after the shooting. Tracing the brand to Chicago retailers, per that account, led investigators to a suspect. [AllHipHop] That detail is currently single-sourced and should be treated as such until it is corroborated.

Grief as Evidence

The second day of testimony is where the case gets philosophically uncomfortable. Prosecutors called an FBI agent to walk jurors through Banks’ text messages in the period after Von’s killing, including a message saying he felt dead inside and another telling an associate to wait on the get back. Read one way, those are the texts of a grieving man in the worst week of his life, written in the vernacular he actually speaks. Read the government’s way, they are the earliest documentary evidence of intent, and everything that follows is execution. The prosecution reportedly also introduced a screenshot sent to Banks about Lul Pab’s death along with video of Rondo’s reaction, noting that Banks changed his phone number roughly 48 hours later without replying. Defense attorney Brian Steel objected to the government’s handling of alleged gang affiliation and challenged the agent’s expertise. [Complex] That fight is the whole ballgame for the defense, because once a jury accepts that OTF is an enterprise rather than a label, ordinary artifacts of a rap career start reading as organizational records.

Why the Indictment Kept Growing

Three weeks before the trial opened, federal prosecutors filed a fourth superseding indictment adding racketeering allegations and characterizing Only The Family as a criminal enterprise whose funds and credit cards paid for flights, rental cars, and weapons. Four superseding indictments across roughly twenty-one months is not, on its own, evidence of weakness. It is evidence of a case being reshaped as cooperators came aboard. But it is also the reason the defense’s celebrity-target argument has any purchase at all. Each new layer widened the frame from a specific alleged act to an alleged organization, and organizations are easier to convict than individuals.

The Room

Courtroom reporting has noted the gallery as much as the evidence: Banks’ father Dontay Banks, his partner India Royale, and artists including G Herbo, Dreezy and Machine Gun Kelly among those attending, along with Robinson’s mother. [Complex] [XXL]

It is worth saying the quiet part: the person at the center of this case is not a rapper. Saviay’a Robinson was 24 and, on the government’s own account, was not the intended target of anything. Whatever the verdict, the trial exists because he was in the car.

What to Watch

The trial is expected to run at least three weeks. [DancehallMag] Two things will decide it. The first is whether the documentary chain, the flights, the cards, the rentals, the GPS, closes without a cooperator having to narrate it. If prosecutors can make the receipts speak for themselves, the defense’s attack on Grant’s credibility loses most of its force. If the records only make sense once Grant explains them, that attack becomes the case.

The second is how far Judge Fitzgerald lets the enterprise theory travel. Every ruling on gang expertise, on lyrics, on what OTF is, moves the trial along a spectrum between a specific murder and a general portrait of a career. The government has spent nearly two years pushing toward the portrait. The defense has spent the same period trying to force the case back down to a single night, a single car, and a man who was somewhere else.

A jury will sort out which frame it believes. Until it does, all of the above remains allegation.

Every allegation described here comes from federal charging documents and reporting on them. An indictment is an accusation, not a conviction; Eugene Henley has denied wrongdoing and is presumed innocent unless and until proven guilty at trial. Nipsey Hussle’s murder was separately prosecuted in state court, where Eric Holder Jr. was convicted; no charge in Henley’s case alleges his involvement in that killing.

Two names from the same few blocks of South Los Angeles have come to mean opposite things. Nipsey Hussle is the martyr-entrepreneur the culture canonized after 2019 — the man who bought back his block. Eugene “Big U” Henley is the power broker that same culture once called a godfather, and that the federal government now calls the head of a criminal enterprise. Their lives were genuinely, documentably intertwined. And because both names carry so much weight, the temptation to staple them into one dark story is enormous. This piece resists that, on purpose. The record is heavy enough without the myth.

The Studio Downstairs

Before he was a symbol, Nipsey was a kid with talent and a mentor with a reputation. Both came out of the Rollin’ 60s Neighborhood Crips, and Henley — already a music manager who’d worked with Kurupt and moved in Death Row circles — took him in early. By Henley’s own account, Nipsey was signed to him for production, lived with Henley’s family, and cut some of his first records in a studio in their home. [Vibe] The Los Angeles Times would later describe Henley flatly as the man who helped launch Nipsey’s career, a figure some in the city called rap’s “godfather.” [LA Times]

That mentorship sat inside a bigger reinvention. After serving 13 years for a 1991 robbery, Henley re-emerged in the mid-2000s and built a public identity as a reformed man — founding the anti-gang nonprofit Developing Options, drawing celebrity donations, and eventually appearing in the 2021 FX docuseries Hip Hop Uncovered as an OG who’d turned toward peace. [CBS LA] Hold onto that image of the mentor-turned-activist. The entire federal case is an argument that it was a mask.

The Equipment and the Diss

The relationship didn’t end in myth. It ended in something small and human. According to court documents reviewed by the Los Angeles Times, the two fell out around 2011 over recording equipment — Henley wanted some of Nipsey’s gear, and the dispute curdled the bond. What happened to Nipsey Hussle is not an open question, and that fact has to anchor everything else. On March 31, 2019, Ermias Asghedom — Nipsey, 33 — was shot and killed outside his Marathon Clothing store in South Los Angeles; two others were wounded. [Fox News] The killer was Eric Ronald Holder Jr., an acquaintance who had spoken with Nipsey that day, left, and returned with a gun. [Yahoo News]

Holder was convicted of first-degree murder and sentenced to 60 years to life in state prison. [The Source] The motive that emerged at trial was personal and small: a conversation, a perceived slight, a man who came back to settle it. No gang order. No enterprise. No Big U. That is the settled, adjudicated truth, and any responsible telling of this story starts and ends there.

The Enterprise the Feds See

Six years after Nipsey’s death, the government came for his old mentor — not over that killing, but over a life prosecutors say was never what it appeared. In March 2025, federal authorities charged Henley in a 43-count indictment anchored by a RICO conspiracy, describing a “Big U Enterprise” that operated like a mafia from roughly 2010 onward. [Billboard] Alleged victims — including professional athletes and musicians — were expected to “check in” with Henley when they came through Los Angeles. [LA Times]

The murder inside that racketeering count isn’t a famous one. Prosecutors allege that in 2021, an aspiring rapper signed to Henley’s label — later identified as Rayshawn Williams — was killed and left in the Nevada desert after recording a song that disrespected him. [LA Times] The government’s wider theory is that the anti-gang activist persona was cover: that Henley used his standing as an OG, his podcasts, and his documentary appearances to project reform while, prosecutors say, invoking beatings and armed enforcement in private. The Word “Discipline”

This is the section that requires the most care, because it’s where Nipsey’s name re-enters the federal file — and where headlines have badly outrun the facts. In a February 2026 superseding indictment, prosecutors added overt acts drawn from calls intercepted in late 2022 and early 2023, years after Nipsey was already dead. [HotNewHipHop] On those calls, prosecutors say, Henley boasted that he was “bigger” than Nipsey, claimed he had “disciplined” him, called himself the “hunter” of the Rollin’ 60s, and delivered general kill-rhetoric about anyone who crossed him. Read carefully, because some outlets didn’t. A man cannot threaten to kill someone who died three years earlier. What prosecutors are actually offering is retrospective bravado — Henley allegedly using his past authority over Nipsey to advertise his own dominance, which the government frames as evidence of a violent racketeering posture. [GenZHipHop] The purpose of the language, in the government’s telling, is to show how he talks about power — not to connect him to a murder the state already solved. That is a crucial distinction, and it is the one the rumor mill erases.

What the Record Does Not Say

So let’s be as plain as the documents are. The federal government does not accuse Eugene Henley of any role in Nipsey Hussle’s 2019 murder. [The Source] Even the reporters who broke the wiretap details said so in the same breath, and noted the transcripts had already restarted old conspiracy theories they could not verify. [AllHipHop]

This is where the culture has to discipline itself. Two heavy facts sitting next to each other — a mentor with a fearsome reputation, a protégé who was murdered — feel like they should connect. They don’t, on the record. Holder killed Nipsey over a personal grievance and is serving 60 to life for it. Collapsing “the feds intercepted Big U talking about Nipsey” into “Big U had something to do with Nipsey’s death” isn’t analysis; it’s internet math, where two scary things are assumed to equal one scarier thing. Repeating it doesn’t just wrong a man awaiting trial. It disrespects what’s actually known about how Nipsey died.

The Case Builds

Whatever the myth does, the docket keeps moving — and lately, against Henley. Prosecutors have repeatedly expanded the case through superseding indictments, adding witness tampering, solicitation of violence, and an interstate sex-trafficking count. [Courthouse News] The gravest new allegation: that from federal custody in June 2026, Henley tried to arrange for two inmates to kill or harm a witness before trial. [AllHipHop]

The human cost has piled up alongside the legal one. In October 2025, Henley’s 34-year-old son, Jabari “Baby Uiie” Henley, was fatally shot in South Los Angeles. [LA Times] Henley and several co-defendants are now set for a joint trial in early 2027, where the racketeering count alone carries a potential life sentence. He maintains his innocence, casting the case as a campaign against a Black man who tried to help his community. [AllHipHop] A jury will decide which version of Big U is the real one.

The Line Between the Record and the Rumor

In the end, this is a story about who gets to write an ending. The culture wrote Nipsey’s: hero, builder, martyr, the man whose marathon continues. The state is trying to write Henley’s: not a godfather, but a predator who wore reform like a costume. Those two projects are happening at once, in the same few square miles, over two men who once shared a house and a dream.

The rumor mill wants a third story that fuses them — that makes Nipsey’s death the dark secret at the center of Big U’s empire. But that story isn’t in the indictment, isn’t in the verdict that convicted Eric Holder, and isn’t ours to invent. If hip-hop takes its own history seriously — and it should, because outsiders rarely will — then the discipline is simple. Report what’s proven. Attribute what’s alleged. Refuse what’s only rumor. Big U will get his trial. Nipsey already got his killer. Everything else is just content, and the culture deserves better than content dressed up as truth.

When we last laid out this case, the single biggest variable was a pending Nevada Supreme Court petition that could have blown it up before a jury ever heard a word. That door has closed. Thirty Years, One Courtroom

There is no DNA, no recovered weapon, and no living eyewitness other than Davis himself, who by his own decades of storytelling was in the Cadillac. [TechTimes] That absence is exactly why the state spent years fighting to get his confessions admitted — and why the defense is spending this month trying to convince a jury those same confessions were fiction.

Two Openings, One Paradox

Chief Deputy District Attorney Binu Palal opened for the state on August 17 with a simple motive: revenge. He told jurors the killing was retribution for the beating of Davis’s nephew, Orlando Anderson, in a casino brawl hours earlier, then walked them through his theory of the night — that Davis obtained a .40-caliber Glock, assembled a crew in a white Cadillac, and passed the gun to the back seat, where Anderson fired into Tupac’s BMW. Then Michael Sanft stood up and did something unusual: he attacked his own client’s credibility. Sanft told jurors the state was dressing up fiction as fact, put a slide on the screen that read simply “Bulls—” over Davis’s statements, and argued there was nothing tying Davis to the crime scene. [AP] [NewsNation] His sharpest point doubled as an attack on the investigation: Davis wasn’t charged back in 1996, Sanft said, because law enforcement itself knew he was “full of crap.” [NewsNation]

The defendant is also the star witness. The state’s whole case is that Keffe D told the truth about himself for years. The defense’s whole case is that he lied.

That is the paradox at the heart of this trial, and it may decide it. Davis is both the accused and the prosecution’s best source against him. Legal analysts watching the openings, including Mark Geragos, noted the obvious trap: after telling jurors not to believe a word Davis ever said, the defense can hardly put him on the stand and ask them to believe him now. The First Witnesses

Testimony opened grimly. He loses authorship of the thing that happened to him.

For thirty years, Jay-Z has sold one idea harder than any single song: own the thing. Own your masters, own the building, own the table everyone else is fighting for a seat at. It is the throughline from a Marcy Projects kid who couldn’t get signed to a $2.5 billion businessman whose catalog now lives in the Library of Congress. [Variety] [Britannica] So there’s a particular irony in the deal that has him trending this month, and it’s worth sitting with, because it exposes the tension underneath the entire empire.

The Album That Built the Myth

Reasonable Doubt turns thirty this year, and to mark it Jay-Z cut a Target-exclusive collector’s edition: a white-vinyl 2LP with commemorative packaging, announced June 1 and on shelves June 26. [Complex] [Target] On its own, a legacy-act retail exclusive is the most ordinary move in music. The friction comes from which album it is, and which store it’s in.

Reasonable Doubt is the origin text of Jay-Z’s ownership gospel. He made it after the majors passed on him, so he and his partners built Roc-A-Fella Records and put it out themselves, the independent move that later “became a blueprint for artists seeking equity instead of simple endorsement checks.” [AllHipHop] The record was inducted into the Grammy Hall of Fame, and The Blueprint later entered the National Recording Registry. [Britannica] The album is, in other words, a monument to doing it yourself, without a corporation’s permission.

Now it’s the centerpiece of a corporate exclusive, and not a neutral one. That’s the move that turned a vinyl reissue into a referendum.

The Boycott He Walked Into

In January 2025, Target rolled back its diversity, equity, and inclusion commitments, ending hiring goals, exiting an industry racial-equity program, and dropping out of the HRC’s corporate index, days after a federal executive order took aim at corporate DEI. [The Independent] The response from Black America was organized and sustained. Atlanta pastor Jamal Bryant launched a 40-day “Target Fast” timed to Lent that drew well over 100,000 sign-ups, built on a simple instruction: divest from Target, spend with Black-owned business instead. [Washington Post] Target’s foot traffic slid, its market value took a measurable hit, and its CEO ended up across the table from Black faith and civil-rights leaders. [Fortune]

And the boycott never cleanly ended. Organizers like Nina Turner and Tamika Mallory kept it running well into 2026, framing it as ongoing economic pressure rather than a one-time protest. [The 19th] So when Jay-Z’s Target exclusive arrived in June 2026, it didn’t land after the fight. It landed in the middle of it. [theGrio]

The backlash was immediate and came overwhelmingly from inside the culture. Critics accused him of crossing a picket line and handing Target exactly what it needed: Black cultural validation to win shoppers back. [Black Enterprise] One commentator’s framing, the “brother billionaire wants y’all back in Target,” captured the sting: that a man whose brand is Black self-determination was being used to repair a brand Black organizers were trying to pressure. [EURweb] Supporters pushed back with his own logic, arguing that exclusive retail deals are industry standard and that he’s not the boycott’s enforcement arm. He also wasn’t the first. Months earlier, Target’s partnership with Kai Cenat’s AMP drew the same charge, and the journalist Jemele Hill had all but predicted the playbook, warning that Target would eventually “give the right Black celebrity a check” to galvanize shoppers back through the doors. From Label to Infrastructure

To understand why the Target deal hit a nerve, you have to see how big the machine behind it actually is. Jay-Z didn’t stay a label boss. In 2008 he folded his business into a joint venture with Live Nation, a roughly $150 million, decade-long arrangement that turned Roc Nation from a record company into a full-service entertainment platform spanning management, publishing, touring, and sports. [Variety] [CNBC] The company is run by a tight inner circle of Jay-Z, vice chairman Jay Brown, and CEO Desiree Perez, a structure that keeps decision-making close to home. [Billboard]

Its pitch to artists is ownership itself. Roc Nation’s distribution arm advertises an 85/15 split in the artist’s favor and lets acts keep their masters, the explicit inverse of the deal a young Jay-Z couldn’t get. [Roc Nation] That’s the brand: not a label that owns you, but infrastructure you can plug into and still own yourself. [Music Business Worldwide]

The catch is that the infrastructure runs through Live Nation, the most contested company in live music. In 2024 the Justice Department and 30 states sued Live Nation and Ticketmaster for monopolizing the concert business, and a jury later found it had operated as an unlawful monopoly. Giving Up the Jersey

The clearest proof that Jay-Z thinks in leverage, not trophies, was the Nets. He bought a sliver of the team around 2003, reportedly about $1 million for a stake so small the press could never agree on it, somewhere between roughly 0.067% and 0.15%. Then in 2013 he sold it, because NBA rules barred him from owning any piece of a team while becoming a certified players’ agent. The Allocator

The most recent phase is the most telling. Jay-Z stopped only building his own companies and started deciding which other companies get built. In 2018 he co-founded Marcy Venture Partners with Jay Brown and investor Larry Marcus, closing an $85 million first fund and a $325 million second one before merging into MarcyPen Capital in 2024. This is a different kind of power than owning your masters. The man who preached ownership to artists is now a gatekeeper of capital, deciding whose vision gets the co-sign and the check. The NFL Deal Was the Rehearsal

None of this is new. The Target controversy is a sequel, and the original ran in 2019, when Roc Nation became the NFL’s live-entertainment and social-justice partner under the “Inspire Change” banner. [Roc Nation] The timing was the problem. The deal came almost exactly three years after Colin Kaepernick’s first kneel, with Kaepernick still effectively blackballed from the league. [Washington Post] When Jay-Z said the moment had moved “past kneeling” toward “actionable items,” a lot of people heard a billionaire giving the league permission to move on. [CNN]

The criticism, again, came from his own. Safety Eric Reid, who’d knelt beside Kaepernick, said Jay-Z was choosing a “business move” and accused him of hiding behind his Black face. Chairman of Culture

What makes this moment louder is that Jay-Z is everywhere again. His empire is real, and so is the cultural shift it drove. Hip-hop now talks about equity, masters, and generational wealth in language Jay-Z helped write. What it forces into the open is not: an empire built on the promise of owning the block, doing business with the store the block is boycotting. Until he answers that, in a statement, a freestyle, or the next deal, the contradiction is the story.

Every few years, someone with a platform announces that hip-hop is over. They did it in 1979, when the first rap record felt like a novelty. They did it again when the sampling lawsuits hit, when CD sales cratered, when streaming upended the old metrics. The announcement is always wrong, and it is always made by people who never understood what they were looking at in the first place. To call hip-hop a fad wasn’t just a bad prediction. It was a coherent worldview — built on assumptions about race, class, and who gets to make lasting culture — and tracing exactly where that worldview came from is the only way to understand why it was so persistent, and so wrong.

Born in the Wrong Zip Code

Hip-hop’s origin story is a 1520 Sedgwick Avenue rec room in the Bronx: DJ Kool Herc looping breakbeats for neighborhood kids in the summer of 1973, MCs talking over records, a culture built on park jams and borrowed streetlight power. [Grammy] That is not how the music business of the 1970s expected a durable genre to announce itself. Labels were built around studios, A&R scouts, live bands, and radio formats with clear demographic maps. Hip-hop was built around community, improvisation, and systems the industry didn’t own and couldn’t immediately monetize.

From the beginning it was framed as youth culture rather than music culture — African American and Latino teenagers using sound, movement, and visual art to document conditions nobody else bothered recording. [The Source] To older executives and editors, that read as a scene that would age out with the block parties, not a foundation that would eventually reorganize the entire global entertainment industry. The Bronx in 1973 was not supposed to be the origin point of anything lasting. That preconception — about place, about class, about whose creativity gets treated as art — is where the “fad” label actually begins.

Even New York radio needed convincing a decade later. When Greg Mack pitched all-rap programming at KDAY in Los Angeles, management treated it as a risky experiment and signed off largely by accident. Once they did and the ratings spiked, KDAY became the first 24-hour rap station — not through industry vision but through reluctant concession to what listeners already wanted. Wayne “Wayno” Clark — Roc-A-Fella intern turned Complex personality turned independent host of “I’ll Do It Myself” — anchors the industry-insider lane. FD Signifier, the former sociology PhD candidate whose multi-hour video essays go from 12 minutes to 3+ hours, has become a kind of public intellectual for the same audience. Jermaine Dupri took 17 HBCU students into the studio. The 2026 Atlanta Falcons HBCU Fellows Program kicked off May 1 with a “Creative Currency Experience” hosted by Dupri and Amir Windom — behind-the-scenes studio access, then a fireside chat on “earn, learn, return.” Three days later the fellows were on a Habitat build with Falcons staff and Wells Fargo volunteers as part of the 40th annual Jimmy and Rosalynn Carter Work Project — first time the project’s been back in Atlanta since 1988. The Roots Picnic is happening this weekend, and The Root is mad about what it’s become. For nearly four decades, American prosecutors have operated under a quiet working assumption: that rap lyrics are autobiography, that violent bars are confessions, and that a jury hearing a Black defendant’s verses will naturally connect the music to the crime. At least 500 criminal cases have turned on that assumption. Some defendants were convicted. Some are still in prison. One was executed. Maryland’s Protecting Artists’ Creative Expression Act — the PACE Act — is the first East Coast state law to formally reject that assumption and force courts to ask a question the system has been ducking since “The Message” hit the radio in 1982: is this evidence, or is it just bias dressed in a legal robe?

The Law: What PACE Actually Does

PACE is deceptively simple in its public framing: Maryland will be the first state on the East Coast to impose consistent standards on how creative expression — rap lyrics, visual art, performance — can be used in criminal proceedings. [CBS Baltimore] It does not ban lyrics from courtrooms outright. What it does is close the loophole that allowed prosecutors to slide rap into evidence on the theory that the defendant wrote it and it sounds violent.

The law’s engine is a four-part test. Before a judge can even consider admissibility, prosecutors must demonstrate that the creative work was intended as a literal statement about the specific facts of the case, is specifically connected to those facts, and is not simply artistic expression or storytelling. [AllHipHop] In other words: no more “he rapped about guns and this is a gun case, therefore the jury should see his mixtape.” The law requires courts to ask whether the lyrics are actually evidence of this crime or just evidence that the defendant makes rap music.

Delegate Marlon Amprey, who represents Baltimore’s 40th district and helped shepherd the bill, has been unambiguous about what practice PACE is designed to stop. Lyrics are “often being used against young Black men, young Latino men, in ways in which they’re trying to say they’re more violent because of the kind of music they create,” he said. [CBS Baltimore] If a song has nothing to do with the facts of a trial, it “shouldn’t be used in court.” That’s a state legislator saying plainly what scholars and artists have argued since the early ’90s: the criminalization of rap is the criminalization of Black expressive culture.
